Terms and Conditions
Effective Date: August 23, 2026
Last Updated: August 23, 2026
These Terms & Conditions ("Terms") govern your access to and use of the website operated by Mindful Bookkeeping, LLC ("Mindful Bookkeeping," "we," "us," or "our"), including the information, materials, features, and resources available through the website (collectively, the "Website").
By accessing or using the Website, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to these Terms, please discontinue use of the Website.
1. PURPOSE OF THE WEBSITE
The Website is provided for general informational and business purposes, including providing information about Mindful Bookkeeping and the bookkeeping services we offer.
We reserve the right to modify, suspend, discontinue, or restrict any portion of the Website at any time without prior notice.
2. NO PROFESSIONAL ADVICE
Information and materials available through the Website are provided for general informational purposes only.
Nothing contained on the Website constitutes or is intended to constitute individualized accounting, tax, legal, financial, investment, or other professional advice.
You should not make financial, tax, legal, accounting, or business decisions solely in reliance upon general information provided through the Website. When appropriate, you should consult a qualified professional regarding your specific circumstances.
3. NO BOOKKEEPER-CLIENT RELATIONSHIP
Accessing or using the Website does not create a bookkeeper-client, accountant-client, fiduciary, advisory, or other professional relationship between you and Mindful Bookkeeping.
Submitting an inquiry, sending an email, scheduling or participating in a consultation, or otherwise communicating with Mindful Bookkeeping does not, by itself, establish a client relationship or obligate Mindful Bookkeeping to provide services.
A client relationship is established only after Mindful Bookkeeping has agreed to accept an engagement and all required service agreements, authorizations, and onboarding requirements have been completed.
4. BOOKKEEPING SERVICES
Descriptions of bookkeeping services appearing on the Website are provided for general informational purposes and do not constitute a binding offer, engagement, or guarantee that any particular service will be provided.
The specific scope of services, responsibilities of each party, pricing, payment terms, and other conditions applicable to bookkeeping services will be established in a separate written agreement between Mindful Bookkeeping and the client.
If there is a conflict between these Terms and an executed client service agreement regarding bookkeeping services, the applicable client service agreement will control with respect to that engagement.
5. PRICING AND SERVICE INFORMATION
Any pricing, price ranges, service descriptions, availability information, or other commercial information displayed on the Website is provided for general informational purposes and is subject to change.
Bookkeeping needs vary by business. Actual pricing may depend on factors including transaction volume, number and type of financial accounts, condition of existing records, complexity of the bookkeeping, and scope of services requested.
No price displayed on the Website constitutes a binding quotation unless expressly included in a written proposal or service agreement provided by Mindful Bookkeeping.
Once a client relationship has been established, pricing and any subsequent adjustments will be governed by the applicable client service agreement.
6. ACCURACY OF WEBSITE INFORMATION
We make reasonable efforts to provide accurate and current information through the Website. However, we do not guarantee that all Website content will at all times be complete, accurate, current, or free from errors.
Information may become outdated, and we reserve the right to correct errors, update information, or modify Website content without prior notice.
7. NO GUARANTEE OF RESULTS
Mindful Bookkeeping strives to provide professional and thoughtful bookkeeping services; however, no particular financial, tax, business, profitability, compliance, or other outcome is guaranteed as a result of using information provided through the Website.
Business owners remain responsible for their business decisions and for determining when advice from a CPA, tax professional, attorney, financial advisor, or other qualified professional may be appropriate.
Any professional bookkeeping services provided to a client are governed by the terms of the applicable client service agreement.
8. THIRD-PARTY WEBSITES AND SERVICES
The Website may contain links to or use services provided by third parties, including appointment scheduling platforms, social media platforms, website hosting providers, and other technology services.
These third parties operate independently of Mindful Bookkeeping. We do not control and are not responsible for their content, availability, security, privacy practices, products, services, or terms.
Your use of third-party websites or services is subject to the terms and policies established by those providers.
9. INTELLECTUAL PROPERTY
Unless otherwise indicated, the Website and its original content, including text, graphics, logos, branding, design elements, and other materials, are owned by or licensed to Mindful Bookkeeping and are protected by applicable copyright, trademark, and other intellectual property laws.
You may access and use Website content for personal or legitimate informational purposes.
Website content may not be reproduced, republished, distributed, modified, sold, licensed, commercially exploited, or used to create derivative works without prior written authorization from Mindful Bookkeeping, except as otherwise permitted by applicable law.
Nothing in these Terms grants any ownership interest or license in the trademarks, trade names, logos, or other intellectual property of Mindful Bookkeeping except as expressly provided.
10. ACCEPTABLE USE
You agree not to use the Website:
- For any unlawful, fraudulent, or unauthorized purpose;
- In violation of applicable laws or regulations;
- To interfere with or disrupt the Website, its servers, networks, or security systems;
- To attempt to gain unauthorized access to any system, account, data, or resource;
- To introduce viruses, malicious code, or other harmful technology;
- To collect information about others through unauthorized means; or
- To infringe upon the intellectual property, privacy, or other rights of Mindful Bookkeeping or any third party.
11. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Website and the information and materials available through it are provided on an "as is" and "as available" basis.
Mindful Bookkeeping makes no warranties, express or implied, regarding the operation, availability, accuracy, reliability, or suitability of the Website or its content.
We do not warrant that the Website will be uninterrupted, error-free, completely secure, or free from viruses or other harmful components.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Mindful Bookkeeping, LLC and its owners, members, employees, contractors, representatives, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your access to, use of, inability to use, or reliance upon the Website or its content.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.
This limitation applies specifically to use of the Website and does not modify, replace, or supersede any liability or indemnification provisions contained in a separate written service agreement between Mindful Bookkeeping and a client.
13. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Mindful Bookkeeping, LLC and its owners, members, employees, contractors, representatives, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Website, violation of these Terms, or infringement of the rights of another person or entity.
This provision relates to use of the Website and does not modify any indemnification provision contained in an applicable client service agreement.
14. PRIVACY
Your use of the Website is also subject to our Privacy Policy, which describes how information collected through or in connection with the Website may be handled.
For existing clients, the collection, use, disclosure, and confidentiality of information may also be subject to the applicable client service agreement.
15. GOVERNING LAW
These Terms and any dispute arising from or relating to the Website shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
Any separate client service agreement may contain additional provisions governing the professional relationship between Mindful Bookkeeping and the client.
16. SEVERABILITY
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
17. WAIVER
The failure of Mindful Bookkeeping to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time.
18. CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms from time to time.
Any revised Terms will become effective when posted to the Website unless otherwise stated. The "Last Updated" date above will reflect the date of the most recent revision.
Your continued use of the Website following the posting of revised Terms constitutes your acceptance of the revised Terms.
19. ENTIRE AGREEMENT REGARDING WEBSITE USE
These Terms, together with the Privacy Policy and any other Website policies expressly incorporated by reference, constitute the agreement between you and Mindful Bookkeeping regarding your use of the Website.
These Terms do not replace, modify, or supersede any separate written service agreement entered into between Mindful Bookkeeping and a client for bookkeeping services.
